If I choose not to take the OPP vehicle home and I receive a call-out am I on overtime from the time I receive the call to when I report to work location in personal vehicle, obtain OPP vehicle, proceed to call, complete call, return vehicle to work location and travel to my residence?  Is the entire period of time overtime and will I be covered by WSIB, insurances as well as all other benefits/entitlements. Will OPP pay mileage for travel in personal vehicle?

Overtime will be paid as per the collective agreement.  Employees driving OPP vehicles are fully covered by all insurance and WSIB benefits.  This applies to all employees whenever they are driving OPP vehicles – only time it may be an issue is if an employee was deemed to be acting improperly
i.e. Impaired while driving OPP vehicle.  The circumstance outlined above is a hypothetical situation and OPP is not aware that it has ever happened.  If the circumstances were to happen it would be reviewed at that time.  OPP will not reimburse mileage for personal travel to work location to pick up vehicle.

No – OPS Travel, Meals Directive states that government vehicles may only be used for government business.

OPP understands that it will take members longer to respond and member can identify that to caller that they will need extra travel time. 

Bureaus are reviewing these issues and are responsible for security.  Officers do have the responsibility to maintain equipment and transport equipment in an appropriate manner.  Employees who have concerns should address it with their individual Managers.

There are two types of covert vehicles – some are registered to the OPP while others are registered under a fictitious name and address.  It our understanding that covert vehicles not registered to the OPP would be exempt due to the requirement of confidentiality and security.

No.  CRA interpretation has ruled that the personal travel from home to work is still a benefit to the employee and therefore attracts a taxable benefit.

No.  CRA considers travel between the two work locations personal use.

CRA does not recognize position exemptions.  Options are to not take the vehicle home, request paid relocation of residence or transfer to another position within the OPP.   The OPP have indicated they will pay relocation costs if requested or if the employee requests to be transferred to another position the employee may work with their Manager to facilitate that request.

OPP is aware of the implications to employees of OPP leasing vs. purchase.  The impact of the employer’s decision does clearly impact the employees.  Analysis is being worked on presently and will most likely have to be reviewed by Ministry of Government Services.  Senior Command is well aware of the issue and is monitoring the outcome of the review.
