Parental leave includes a birth parent, legal parent, a person with whom the child is placed for adoption, and a person who is in a relationship of some permanence with the parent of a child and who intends to treat the child as their own.
35 weeks (pregnant member)/37 weeks (birth parent, legal parent and adoptive parents) – paid within 52 week period
61 weeks (pregnant member)/63 weeks (birth parent, legal parent and adoptive parents) – paid within 78 week period
Note: Under the federal Employment Insurance Act, the federal government introduced the Parental Sharing Benefit which is an additional benefit that can increase the standard leave EI benefit by 5 weeks and the extended leave EI benefit by 8 weeks. While the benefit is extended to up to 69 weeks under this act, consistent with the Ontario Employment Standards Act, the maximum leave under our Collective Agreement remains at 61 weeks. Thus, the additional time off required to access the Parental Sharing Benefit is within the OPP’s discretion
As per the Civilian CA, Article 13.06.07 & the Uniform CA, Article 9.04.07 – upon application in writing at least two (2) weeks prior to the expiry of the parental leave, to a further consecutive leave of absence without pay but with accumulation of credits for not more than six (6) weeks.
Pregnant member: Parental leave must begin immediately following pregnancy leave and be taken continuously.
Other Birth, Legal or Adoptive parent: Parental leave may begin no earlier than the day the child is born or comes into the custody, care and control of the parent for the first time.
Note: Parental leave should start on a Sunday, which is consistent with EI reporting period
NOTE: Members can receive parental benefits from Service Canada within specific periods starting the week after the child’s date of birth or the date the child is placed with them for the purpose of adoption. These periods are:
Standard parental: within 52 weeks (12 months)
Extended parental: within 78 weeks (18 months)
Members must be in receipt of EI parental benefits to receive the SUB-Allowance from employer.
Proof of Employment Insurance (EI) (gross and net amount of EI Benefit) for Parental Benefits through Service Canada at www.canada.ca is required prior to Ontario Shared Services (OSS) processing any SUB-Allowance benefit, i.e. member must be in receipt of EI Parental Benefits to receive SUB-Allowance.
Parental leave that begins on or after January 1, 2020:
First week – Civilian CA Article 13.06.09.02 (a) & Uniform CA Article 9.04.09.02 (a):
Members are eligible to receive 93% (SUB-Allowance) of the actual weekly rate of pay which they were receiving on the last day worked prior to the commencement of the parental leave, including any progression on the wage grid and any negotiated or amended wage rates for their classification as they are implemented.
Fifteen (15) weeks – Civilian CA Article 13.06.09.02 (b) & Uniform CA Article 9.04.09.02 (b):
Up to a maximum of 15-weeks, payments equivalent to the difference between the sum of the weekly Standard EI Parental benefits, the employee is eligible to receive and any other earnings received by the
employee, and ninety-three (93%) of the actual weekly rate of pay for their classification, which they were receiving on the last day worked prior to the commencement of the parental leave, but which shall also include their progression on the wage grid and any negotiated or amended wage rates for their classification as they are implemented.
Further one (1) week – Civilian CA Article 13.06.09.02 (c) or (d) & Uniform CA Article 9.04.09.02 (c) or (d):
Members are eligible to receive 93% (SUB-Allowance) of the actual weekly rate of pay which they were receiving on the last day worked prior to the commencement of the parental leave, including any progression on the wage grid and any negotiated or amended wage rates for their classification as they are implemented.
The further one week of leave must be taken immediately after the date when the EI benefits referenced in the Civilian CA Article 13.06.09.02(b) & Uniform CA Article 9.04.09.02 (b) have terminated and prior to returning to the workplace.
